These Terms of Service ("Terms") govern your use of Informed Boating ("the Service"), operated by Frankventure LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
Informed Boating is a vessel intelligence platform that helps users research, evaluate, purchase, manage, and enjoy boats. The Service includes intelligent analysis, document processing, data storage, and collaboration features.
You must provide accurate information when creating an account. You are responsible for maintaining the security of your password and account. You must be at least 18 years old to use the Service.
You own your data. All vessel information, documents, photos, and other content you upload remains your property. We do not claim ownership of your content. You grant us a license to process, store, and display your content solely to provide the Service.
You can export your data at any time using the export feature. If you delete your account, we will delete your data within 30 days.
The Informed FirstMate is not a substitute for professional advice. The Informed FirstMate provides informational analysis based on the data you provide. It is not a licensed marine surveyor, broker, mechanic, or financial advisor. You should not make purchase decisions, safety decisions, or maintenance decisions based solely on analysis generated by the Informed FirstMate.
Informed FirstMate risk assessments, cost estimates, and vessel comparisons are approximations. Always verify critical findings with qualified professionals.
You agree not to: (a) use the Service for any unlawful purpose; (b) upload malicious content or attempt to compromise the Service; (c) share login credentials with unauthorized users; (d) resell or redistribute the Service without authorization; (e) use automated tools to scrape or bulk-access the Service.
The Service offers Free, Pro, and Broker plans. Plan features and pricing are described on our website. We may change pricing with 30 days notice to existing subscribers. Paid plans include a 14-day free trial. You can cancel at any time - your access continues through the end of the billing period.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
We are not responsible for decisions you make based on information provided by the Service, including analysis, risk assessments, or cost estimates generated by the Informed FirstMate.
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects access. We will provide reasonable notice of planned maintenance when possible.
You can delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, you may export your data for 30 days before deletion.
We may update these Terms. We will notify you of material changes via email or in-app notification. Continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
